Wieden + Kennedy Program The Kennedy’s
- These Terms & Conditions apply to your (application for) participation in our program The Kennedys (see www.thekennedys.nl). In order to apply for and participate in this program you first need to accept these terms. Any deviation from these terms must be made in writing and duly signed by a representative of Wieden & Kennedy.
- You confirm that all personal information that you have provided in your application is true and complete. In the event that any of the information provided by you would turn out to be false or incomplete, we have the right to terminate your participation in the program with immediate effect and without incurring any liability as a result thereof.
- In order to participate in the program you must be at least 18 years of age and have a valid EU passport (only ID card will not be sufficient). You confirm that you have no criminal records and that there are no criminal proceedings pending against you.
- The application for the program is made online at www.thekennedys.nl where you must complete and submit the application form with all required personal information, CV and portfolio. You must follow the instructions on our website and in the online application form.
- Wieden + Kennedy will inform you by e-mail if you are selected for the program by April 30th, 2012. If you are not contacted by April 30th, 2012, you are not selected. We will not discuss the status of your application and you are not able to request the status of your submission. Wieden + Kennedy reserves the right to select candidates for the program through other channels than this application procedure.
- The intellectual property rights of all works created by you answering the application questions for entry into the program shall remain with you, butWieden + Kennedy has the exclusive right to use and alter these works for commercial or non-commercial purposes, worldwide, in perpetuity and for allmedia. If you are selected to participate in the program, you agree to assign the worldwide copyright and all other rights of intellectual property on the material especially made to enter the program to the fullest extent to Wieden + Kennedy free of charge. You hereby agree to fulfill all necessary formalities to effectuate such assignment at Wieden & Kennedy’s first request.
- The intellectual property rights of all works specifically made for this program that answer the application question shall remain with you, but Wieden + Kennedy has the exclusive right to use and alter these works for commercial or non-commercial purposes, worldwide, in perpetuity and for all media. If you are selected to participate in the program, you agree to assign the worldwide copyright and all other rights of intellectual property on the material especially made to enter the program to the fullest extent to Wieden + Kennedy free of charge. You hereby agree to fulfill all necessary formalities to effectuate such assignment at Wieden & Kennedy’s first request.
- All works created by you during the program shall be owned by Wieden + Kennedy under the “works made for hire” clause of article 7 of the Dutch Copyrigh Act. You shall waive, to the extent permitted by law, any moral rights under article 25 Copyright Act that you may have with regard to these works.
- The program is expected to take place from June 1st, 2012 to November 30th, 2012. Wieden + Kennedy reserves the right to cancel the program either in part or wholly. The contents of the program are solely determined by Wieden + Kennedy and we reserve the right to make any changes thereto at all times.
- If you are selected for the program you will enter into an employment agreement with Wieden + Kennedy for a definite period of six months. The employment agreement may be terminated by either party before the expiry date during the trial period of one month and after the trial period under observance of a notice period of one calendar month. The employment agreement will include a non-disclosure clause and will be governed by Dutch law only. If you do not accept the terms of the employment agreement and/or if this agreement is not signed by you before the start of the program, Wieden + Kennedy has the right to cancel the program for you without incurring any liability as a result thereof.
- For the program you are required to move to Amsterdam to the housing facilities that Wieden + Kennedy will arrange for you at our expense, for which you will need to sign a separate housing agreement. Wieden + Kennedy will provide you with a single airline ticket from your home country to Amsterdam for you at the beginning of the program and a return ticket at the end of the program. All further travel expenses will be for your own account. You must open a bank account in the Netherlands, which we will help you with.
- When in Amsterdam you will be obliged to take out Dutch health insurance which Wieden + Kennedy will help you set up. You should inform us of any special circumstances that may be relevant for us to know in relation to your participation in the program.
- The personal information submitted in your application will be kept strictly confidential and will only be used for the purpose for which it is submitted. Wieden + Kennedy will process and store the personal information submitted by you in accordance with the applicable privacy laws.
- Wieden + Kennedy will not be liable for any damage that you may suffer during your stay in Amsterdam and during your participation in the program, as a result of loss or theft of goods or for any injury that is caused outside working hours. You are advised to take out an insurance policy to cover all possible damages and liabilities towards third parties. Any liability of Wieden + Kennedy towards you or any third party is limited to the amount paid out by our insurance company for the damage concerned.
- The legal relationship between you and Wieden + Kennedy is exclusively governed by Dutch law. Any dispute that may arise in connection with these terms and any subsequent agreements shall exclusively be submitted to the competent Court in Amsterdam, the Netherlands.
